Terms of Service

These Terms of Service ("Terms") govern your use of Scrub ("the Plugin"), a workflow plugin for Adobe Premiere Pro published by Zac Surprenant ("we", "us"). By installing or using the Plugin you agree to these Terms.

License

When you purchase the Plugin through the Adobe Marketplace, you receive a non-exclusive, non-transferable license to install and use the Plugin on machines you own or control, for personal or commercial work, subject to these Terms and the Adobe Marketplace terms under which you obtained it.

You may not:

  • Resell, sublicense, rent, or redistribute the Plugin or any part of it.
  • Reverse-engineer, decompile, or modify the Plugin except as permitted by applicable law.
  • Remove or alter any copyright, trademark, or attribution notices.

Eligibility and account

The Plugin is distributed through the Adobe Marketplace. You are responsible for maintaining your Adobe account and for complying with Adobe's own terms. We do not operate user accounts and do not store your purchase or licensing information; entitlement is managed by Adobe and the payment processor (FastSpring).

Updates

We may release updates that add, change, or remove features. Updates are delivered through the Adobe Marketplace. We are not obligated to provide updates indefinitely, and a future version may require a newer version of Adobe Premiere Pro.

Third-party tools

The Conform module can launch external command-line tools (for example, REDCINE-X PRO's redline and FFmpeg) from paths you configure. These tools are not part of the Plugin and are governed by their own licenses and terms. We are not responsible for their behavior, output, or licensing.

Your content

The Plugin runs locally and operates only on the project files, sequences, and folders you direct it to. You retain all rights to your media and projects. We never receive, transmit, or store your content — see the Privacy Policy for details.

Disclaimer of warranty

The Plugin is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

The Plugin performs operations that modify Premiere Pro projects, write files to disk, and invoke external tools. You are responsible for maintaining backups of your projects and media before running batch operations such as media replacement, rename, organize, or conform.

Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, projects, media, revenue, or profits, arising out of or related to your use of the Plugin — even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or related to the Plugin will not exceed the amount you paid for the Plugin in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions our liability is limited to the smallest amount permitted by law.

Refunds

Refund requests are handled by the Adobe Marketplace and the payment processor (FastSpring) under their respective policies. Contact hello@zacsurprenant.com if you need assistance opening a refund request.

Termination

These Terms remain in effect while you use the Plugin. We may suspend or terminate your license if you materially violate these Terms. On termination, you must uninstall the Plugin. Sections covering disclaimers, limitation of liability, and governing law survive termination.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date at the top of this page. Continued use of the Plugin after a change constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of Ontario, except where mandatory consumer-protection law in your jurisdiction provides otherwise.
